You are allowed to operate from EU to Non-EU countries, if these countries does not have any authorisation requirements.

A Community licence under Regulation (EC) No 1072/2009 entitles road haulage operators established in an EU Member State to carry goods for hire or reward within the entire EU/EEA (including Switzerland).

The consolidated Regulation (including amendments from Regulation 2020/1055 effective from 21  February 2022) governs access to the international road freight market across EU territory.

REQUIREMENTS

Requirements for Licence Applicants and Carriers

A carrier is a person registered in the commercial or non-profit register and holding a Community licence under the Road Transport Act.
 

Licence applicants and carriers must:

  • Meet the requirements of Article 3(1) of Regulation (EC) No 1071/2009 and Article 7 of the Road Transport Act

  • Be registered in the commercial or non-profit register

  • Provide the address of their establishment in the relevant jurisdiction where the documents under Article 5(a) of Regulation (EC) No 1071/2009 are kept

  • Ensure applicants, carriers, and Chief Executives are of good repute

  • Appoint at least one transport manager who is of good repute and occupationally competent; replace them if changed

  • Have at least one goods vehicle within six months of obtaining the licence and hold a certified true copy of the licence

  • Have no significant tax arrears and not be bankrupt

  • Confirm possession of necessary technical equipment and premises for transport management

  • Ensure vehicles used in international transport return to an operational centre in the relevant jurisdiction at least every eight weeks

  • Pay the applicable service fee to the regulator

  • Ensure drivers comply with transport regulations and hold required professional or ADR training certificates

PROCEDURE

Operating freight transport across EU borders requires a Community Licence under Regulation (EC) No 1072/2009. Whether you’re expanding your logistics business or starting a new venture, securing the right authorisation is essential to avoid penalties, delays, or impoundments.

To obtain a licence, the following must be submitted:

  • Completed application form

  • Name and personal ID code (or date of birth) and contact details of the Chief Executive

  • Document confirming appointment of the transport manager if exists

  • The labor agreement with the transport manager if exists

  • Proof of the transport manager’s occupational competence

  • If the transport manager is appointed under an employment or service contract (per Article 4(1) of Regulation (EC) No 1071/2009), the designation document must include or be accompanied by contract type, parties, date, and duration

Processing of Application

  • Applications are processed within 30 calendar days. Decisions are sent by email or post. A licence is not granted automatically if no decision is made in time.

  • The Community licence is issued on paper to the legal representative or an authorised person.

  • If the application is incomplete, the applicant is given time to correct it. Processing is paused until deficiencies are fixed.

  • Licences are valid for 10 years (or shorter upon request). To renew, a new application must be submitted at least 30 days before expiry.

Changes to Licence Conditions

  • Changes (e.g. transport manager, contact details) must be reported in writing within 28 days.

  • If licence details (e.g. name or address) change, a new Community licence must be applied for.

  • In case of loss, theft, destruction, or change of address, a replacement licence may be issued. Validity is limited to the term of the original. 

Suspension or Termination 

  • Operators may request suspension, revocation, or termination of economic activities by submitting a written request.

  • Grounds in Article 13(3) of Regulation (EC) No 1071/2009 or related provisions apply

  • The carrier, transport manager, or drivers have repeated serious infringements not cleared from the Criminal Records Database

  • A precept was issued and deficiencies were not corrected

  • There are multiple penalties for violations of driving/rest time or Traffic Act sections 261'6–261'9

  • Legal grounds under EU or national law apply

  • Deficiencies identified in a precept or inspection remain uncorrected

  • Repeated serious infringements or obstruction of supervision occurred and are recorded in the Criminal Records Database

  • The licence was not collected within 6 months or no vehicle was registered within that period as required
